    Plain-language summary: eCartar is a real estate analysis tool — not financial advice. Your data belongs to you. We charge what we say we charge. You can cancel anytime. We work hard to be accurate, but you're responsible for your investment decisions.
  

1. Agreement to terms

By creating an account or using eCartar ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and eCartar ("we," "us," "our").

We are in the process of formal incorporation. These Terms will be updated with the legal entity name and jurisdiction once incorporation is complete.

2. Description of service

eCartar is a software-as-a-service platform that provides real estate investment analysis tools, including but not limited to: underwriting calculations, financial projections, portfolio management, AI-powered analysis, document scanning, and market intelligence.

The Service is provided on a subscription basis with three tiers: Basic (free), Pro ($39/month), and Max ($99/month). Features vary by tier as described on our Pricing page.

3. Not financial advice

    Important: eCartar is an analysis tool. It is not a licensed financial advisor, investment advisor, broker, or fiduciary. The calculations, projections, AI-generated analyses, and market data provided through the Service are for informational purposes only and do not constitute investment advice, financial advice, tax advice, or legal advice.
  

You are solely responsible for your investment decisions. You should consult with qualified financial, legal, and tax professionals before making any investment. We make no representations or warranties regarding the suitability, accuracy, or completeness of any analysis for your particular situation.

While our underwriting engine uses deterministic, hard-coded financial calculations designed to be accurate, no software is free from bugs or errors. You should independently verify any analysis before relying on it for investment decisions.

4. Accounts

4.1 Registration

To use eCartar, you must create an account with a valid email address. You must be at least 18 years of age. You agree to provide accurate, current, and complete information during registration.

4.2 Account security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@ecartar.com if you become aware of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4.3 One account per person

Each account is for a single individual. Sharing account credentials with others is prohibited. If you need multiple users, contact us about team or enterprise arrangements.

5. Subscription plans and billing

5.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.

5.3 Upgrades

You may upgrade your plan at any time. When upgrading, you will be charged the prorated difference for the remainder of your current billing cycle.

5.4 Downgrades

You may downgrade your plan at any time. The downgrade will take effect at the end of your current billing cycle. Your data will be retained but features exclusive to the higher tier will become inaccessible. If your investment count exceeds the new plan's limit, existing investments will remain accessible in read-only mode, but you will not be able to create new investments until you are within the limit.

5.5 Cancellation

You may cancel your paid subscription at any time. Cancellation takes effect at the end of your current billing cycle. You will retain access to paid features until the end of the period you have already paid for. After cancellation, your account reverts to the Basic (free) plan.

5.6 Refunds

We generally do not offer refunds for partial billing periods. However, if you experience a significant service issue, contact us at support@ecartar.com and we will work with you to find a fair resolution. Annual subscriptions cancelled within 14 days of purchase are eligible for a full refund.

5.7 Price changes

We reserve the right to change subscription pricing. If we change pricing, we will provide at least 30 days' notice via email. Price changes will not affect your current billing cycle. You may cancel before the new pricing takes effect.

6. Your data

6.1 Ownership

You own your data. All investment data, financial inputs, uploaded documents, and analysis results you create through eCartar belong to you. We do not claim any ownership over your content.

6.2 License to us

By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service to you. This license terminates when you delete your account.

6.3 Data export

You may request an export of your data at any time by contacting support@ecartar.com. We will provide your data in a standard format within 30 days.

6.4 Data deletion

You may delete individual investments (Pro and Max plans) or request full account deletion. Upon account deletion, we will remove your personal data and investment data within 30 days, except where retention is required by law. See our Privacy Policy for details.

7. AI-powered features

Certain features available on the Max plan use artificial intelligence (provided by Anthropic's API) to analyze investment data and generate insights. Regarding these AI features:

AI-generated analysis is provided for informational purposes only and should not be relied upon as the sole basis for investment decisions.
AI outputs may contain inaccuracies, incomplete information, or errors.
Investment data sent to the AI is processed by Anthropic solely to generate your analysis and is not used to train AI models.
We do not guarantee the availability, accuracy, or timeliness of AI-powered features.
AI features may be modified, suspended, or discontinued at any time.

8. Acceptable use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to other users' accounts or data
Reverse engineer, decompile, or disassemble any part of the Service
Use the Service to build a competing product
Resell, sublicense, or redistribute access to the Service
Use automated tools (bots, scrapers) to access the Service in a manner that exceeds reasonable use
Upload malicious files or content designed to compromise the Service
Misrepresent your identity or impersonate another person

We reserve the right to suspend or terminate your account for violation of these terms, with notice where practicable.

9. Intellectual property

9.1 Our IP

The eCartar platform — including its software, design, branding, calculation engine, documentation, and all related intellectual property — is owned by eCartar and protected by copyright, trademark, and other applicable laws. These Terms do not grant you any rights to our intellectual property beyond the limited right to use the Service as described herein.

9.2 Your IP

As stated in Section 6.1, you retain all rights to the data and content you create through the Service.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Service will be uninterrupted, error-free, or secure
Calculations or AI analyses will be free from errors
Market data or intelligence will be accurate or current
The Service will meet your specific requirements

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, eCARTAR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITY, OR INVESTMENT LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO eCARTAR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold eCartar harmless from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Dispute resolution

13.1 Informal resolution

Before filing any formal legal action, you agree to contact us at legal@ecartar.com and attempt to resolve the dispute informally for at least 30 days.

13.2 Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

13.3 Jurisdiction

Any dispute not resolved informally shall be brought exclusively in the state or federal courts located in Duval County, Florida. You consent to the personal jurisdiction of these courts.

14. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms, engage in fraud, or if required by law. We will provide reasonable notice where practicable. Upon termination, your right to use the Service ceases immediately. Sections 3, 6.1, 10, 11, 12, and 13 survive termination.

15. Modifications to terms

We may modify these Terms from time to time. If we make material changes, we will notify you via email or a prominent in-app notice at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms. If you do not agree to the changes, you may cancel your account before the changes take effect.

16. Miscellaneous

Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and eCartar regarding the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in effect.
Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
